Remember, time is of the essence, you only have 30-calendar days to respond to an FSA denial letter.  

When You Receive a Denial Letter from the FSA
  1. You only have 30 days to respond to a denial letter. TIME IS OF THE ESSENCE. 

  2. Keep the envelope with the date stamp on it. 

  3. Notify an experienced attorney of this matter. 

  4. A response to the FSA will include an authorization from you for your attorneys to represent you in this matter within the 30-day response period. 

  5. The response will also include a brief Appellant position as to why we think the FSA is wrong. 

  6. Then a pre-hearing conference is scheduled to determine a hearing date, and hear any objections to the Agency Record or the Appellant's evidence. 

  7. All the evidence is presented, including testimony, at hearing in front of a USDA Administrative Law Judge (ALJ).

  8. The Judge then issues a determination in your case, either the Agency erred in its finding or not. 

  9. Your case depends a lot on:

    • Good record keeping​, including invoices, roles of participants, sales records, time a date of events, etc.

    • A properly documented family farm.

    • Disputing the agency's interpretation of the weather during the crop failure event. (We use experts if necessary).

    • Proving that the producer used sound and proper farm practices. (Experts if necessary).

    • Pointing out the missing documents from the Agency Record.

    • Providing testimony from the producer or former FSA employees to dispute the Agency's position. 

    • Wrapping it all up into a proper and detailed closing argument.
